When you pursue compensation for an injury you suffered in a car accident, fault is not necessarily proven. Instead, it must be determined either by an insurance company or the court (if the case goes to trial) who caused the car accident or to what degree each driver is responsible for causing the accident. Each state has its own system for determining fault. Oklahoma follows what is called a “modified comparative negligence rule.” In this system, you can recover compensation only if you are 49 percent or less at fault in causing the car accident. The amount of compensation you can recover will depend on your degree of fault. So the greater your degree of fault, the less you can recover. If you are 50 percent at fault or more, you cannot recover compensation.
