Job Injury? You May Be Entitled to More Than Workers’ Comp
March 2026
Many Oklahoma workers believe workers’ compensation is their only option after a serious injury on the job. However, some serious workplace injuries may give injured employees the right to pursue compensation beyond workers’ comp benefits alone.
Across Oklahoma, serious job injuries may result from unsafe job sites, defective tools or machinery, vehicle accidents while working, employer negligence, and other dangerous conditions. In some situations, these injuries may involve legal claims against parties other than the employer.
Some serious job injuries may involve:
Unsafe job sites
Defective tools or machinery
Vehicle accident injuries while working
Employer negligence
Other serious job injuries
Because every case is different, injured Oklahoma workers should understand that workers’ compensation may not always be the only source of recovery.
Self & Associates has been helping Oklahoma job injury victims for over 40 years.
When a Workplace Injury May Lead to a Lawsuit Against an Employer
In rare occasions if it can be shown the employer required work to be done that the employer knew that someone would be injured, the exclusive remedy of workers compensation can be lifted and a direct action against the employer can be made.
Example of a dangerous workplace ladder accident that may involve a third-party product liability claim.

Employees are defined under Oklahoma law as "any person engaged in the employment of an employer covered by the terms of the Workers' Compensation Code." It can also include Oklahoma National Guard members employed by state order, as well as volunteers for authorized organizations that are performing services as a firefighter, peace officer, or emergency management worker. It also refers to a participant in a certified sheltered workshop program.
Who Is an Employer?
An employer is, except for certain exemptions, "a person, partnership, association, limited liability company, corporation, the legal representatives of deceased employers" or state and local governments.
What Is a Compensable Injury?
A compensable injury for workers' compensation must arise "out of and in the course of employment." It is divided into two major categories. One category is caused by a specific incident that is identifiable in time, place, and occurrence. The other, called cumulative trauma, does not have to be associated with a specific instance. It includes cardiovasacular, coronary, pulmonary, respiratory, or cerebrovascular accident or myocardial infarction, but only when it can be established that a work-related activity is the major cause of harm, and it has to be shown that these were caused by extraordinary circumstances.
In addition, compensable injury covers damage to your prostheses like eye glasses, glass eyes, replacement limbs, and others that are considered "medically necessary."
It does not include psychological injury or trauma, unless it's related to a physical injury or crime of violence that occurs "out of and in the course of employment."
Proving Compensable Injury
Unfortunately, Oklahoma law puts the burden of proof on you for showing that your injury is compensable. To do this, you must show:
You were injured, using "objective medical evidence"
Your injury was related to your work
Your injury was not due to recreational or social activities
Was not due to aging, natural causes, or diseases not related to work
Workers' compensation laws differ slightly from state to state; however, you may be entitled to the following compensation if you have been injured on the job:
Wages lost due to work missed or decreased earning capacity
Medical bills
Other medical expenses
Compensation to dependents if employee was killed
How do I know if I am eligible for workers' compensation benefits?
To be eligible for workers' compensation, you must be unable to work for more than 3 calendar days due to a personal injury suffered from your working environment. To find out if you are eligible for workers' compensation and to find out what compensation you may be entitled to, please schedule a free case evaluation with Oklahoma City workers' compensation lawyer James Self. Mr. Self has the experience you need to recover compensation for your on-the-job injuries.
How are my workers' compensation benefits calculated?
Your benefits will be based on the type of impairment and the benefits allowed by law. After your doctor has evaluated the percent of your impairment, the level of your disability can be determined. Your workers' compensation benefits are then calculated based on the state's average weekly wage (SAWW) and your average weekly wage (AWW).
How long do I have to report an injury to my employer?
It is a good idea to immediately report any injury you suffered from a work related accident to your employer. Your claim for workers' compensation may be denied if you do not report your injury to your employer or seek medical attention for your injury within 60 days following your accident.

Ensure tools and facilities are properly maintained
Report a fatal accident to the OSHA within eight hours
Report an accident that results in three or more employees being hospitalized to the OSHA within eight hours
Provide all employees with proper safety training and a medical evaluation when required
All employers in Oklahoma are required to carry Workers’ Compensation insurance, even if the company only has one part-time employee. The policy must be issued by an insurance carrier that is authorized by the Oklahoma Insurance Commissioner. If an employer fails to meet these standards, they are subject to fines and other penalties.
