What to Do after an Auto Accident

Following a car accident, you may feel overwhelmed, angry, or unsure of what to do next.

If you are wondering what to do after an auto accident, the proper steps include:

  • Seek medical attention.
  • Call the police.
  • Exchange contact and insurance information with the other driver.
  • Get the contact information of any witnesses to the car accident.
  • If you are able, take photos of damage, car positions, traffic, and your injuries.

After an accident, it is very important to limit your conversation with the other driver so you do not admit fault. After an accident, it will be unclear who is at fault, and to what degree. Admitting fault or apologizing for the accident may prevent you from pursuing compensation later.

If your injury appears serious, you should contact our car accident lawyer, James Self, right away. We will examine the details of your accident to determine who was at fault. If the other driver played a role because of distracted driving or other careless behavior, you may be entitled to pursue compensation for your injuries. What If the Person that Caused My Car Accident Has No Auto Insurance?

It is a frustrating situation when you find yourself in the aftermath of a car accident that wasn’t your fault, only to find that the person who hit you does not have insurance. If you have full coverage like all Oklahoma City drivers should have, your insurance company should pay for your uninsured motorist claim. However, not all insurance companies are willing to offer assistance, and if your insurance company is unwilling to help, no matter what the terms of your policy, you should contact an Oklahoma City car accident attorney to learn more about your legal options.

Your Own Insurance Company Can Help

Whether your policy includes underinsured/uninsured motorists coverage or not, you should be able to collect some amount of compensation for the accident, since it was not your fault. Your insurance company should pay to have your vehicle repaired even if it means filing your own claim. An injury attorney in Oklahoma City can help you file a claim and recover the damages you deserve.

There are often overlapping insurance policies that may be able to help. You may be able to recover damages for your injuries if you were occupying a vehicle that had uninsured motorists coverage. If you were a passenger, your own insurance policy may cover your injuries, even if the driver does not have the proper insurance. Be sure to check with your insurance representative about the language of your insurance policy. Keep in mind that an uninsured motorist claim must be filed within two years of the accident for you to claim damages.

If you have been injured by an uninsured driver in Oklahoma City, please contact Self & Associates for a free initial consultation.

Why Do I Need an Attorney for My Car Accident?

An attorney’s role after your car accident is to ensure you receive the maximum compensation possible. An attorney can also make sure you are not taken advantage of.

Your attorney will work on your case, helping make sure you receive proper medical and rehabilitative care and are able to fully recover. When you attempt to do these things yourself, you may be inadequately cared for, or offered a settlement that is grossly less than you deserve.

Insurance Company Tactics to Minimize Your Settlement

In addition to assisting you in receiving proper care, Oklahoma auto accident attorney Jay Self will deal with both your insurance company, and the company that represents the responsible party. Insurance companies are only concerned with protecting their profits, and their adjustors will do anything possible to coerce you into accepting a settlement before you contact our office. The primary advantages to insurance companies of getting victims to accept their offers without legal representation are:

  • You do not know your legal rights
  • You do not know how to build a sufficient legal or medical case
  • You may believe their offer is as good as it gets

Offers from insurance are seldom as good as it gets. You deserve full compensation for your injuries and, with over 30 years of experience helping victims in Oklahoma, Jay Self can help you get every penny you are due.

How do I legally Prove who was at fault for a Car Accident?

When you pursue compensation for an injury you suffered in a car accident, fault is not necessarily proven. Instead, it must be determined either by an insurance company or the court (if the case goes to trial) who caused the car accident or to what degree each driver is responsible for causing the accident.

Each state has its own system for determining fault. Oklahoma follows what is called a “modified comparative negligence rule.” In this system, you can recover compensation only if you are 49 percent or less at fault in causing the car accident. The amount of compensation you can recover will depend on your degree of fault. So the greater your degree of fault, the less you can recover. If you are 50 percent at fault or more, you cannot recover compensation.

Attorney James Self and our accident law team will act aggressively to pursue the compensation you deserve, whether your injury was caused by a distracted driver or other careless actions. If you face the insurance company on your own, the company is likely to offer you an unfair amount, or you may not be offered compensation at all. By carefully examining the details of your case, we can fight for the maximum amount of compensation for your injury-related expenses.

Pedestrian / Vehicle Accidents in Oklahoma City

Accidents involving pedestrians and cars or trucks can be some of the most serious or even deadly. They are common at crosswalks, in parking lots, and shopping areas. If you are a pedestrian who is hit and suffers a serious personal injury by a car, you may feel totally helpless, but there are some things you can do to protect yourself or your loved ones.

What to do after You have been Hit by a Car

  • Call 911 right away, or have someone do it for you. The police and medical responders will take care of your medical needs and create a report of the incident. If you are able to talk to the police, make sure to give them as much information as possible.
  • Use your cell phone camera to document whatever you can. Photographic documentation can be valuable evidence in the hands of the experienced personal injury attorneys at Self & Associates.
  • If there are any witnesses, ask for their names and phone numbers. Ask them to take a moment to write down what they saw, and if possible to make a statement to the police.
  • Exchange names, addresses, phone numbers and any insurance information with the driver who hit you.
  • Make note of details surrounding the accident such as the date, time, location, and weather conditions. If you have a poor memory or cannot write, use your cell phone voice recorder function to make notes.
  • Once you are able, it is a good idea to contact Self & Associates to get informed about your rights.
  • If you are contacted by the driver’s insurance company, do not offer any information. Insurance companies can be very tricky when it comes to getting information that could make it so they do not have to pay.

Defective Tires and Car Accidents

Tire blowouts are responsible for an estimated 10,000 car accidents each year in the United States. Unfortunately, many of these accidents are severe, and some of them are caused by defective tires and could have been prevented. In recent years there have been a handful of high-profile tire recalls, which reiterate the dangers of a tire defect. In fact, since the National Traffic and Motor Vehicle Safety Act was passed in 1966, more than 24 million tires have been recalled due to safety issues.

Oklahoma City drivers rely on their tires to safely grip the road and help them maintain control of their vehicle. This is especially important if you are driving on slick, icy or otherwise dangerous roads. A defective tire can cause you to lose control of your vehicle, which may result in catastrophic and life-changing injuries.

Common reasons for a tire failure include:

  • Tire tread separation
  • Defective tire valve stems
  • Bolt problems
  • Tire bead failure
  • Zipper failure
  • Joint problems
  • Multi-piece wheel explosions
  • Belt adhesion

Just because your tires were manufactured by a well-known company such as Cooper, Goodyear, or Firestone, it does not mean they are safe. All of these companies have recently issued recalls for defective tires.

If you have suffered an injury in a car accident, please contact Self & Associates in Oklahoma City today to arrange a no-cost consultation.

What to Do After a Car Accident

A car accident may only take a few seconds, but its impact can last a lifetime. In the minutes following a car accident, the involved parties are shaken and may be in a minor state of shock. However, the steps you take following a car accident can make all the difference while speaking with the authorities and dealing with the insurance company.

There are several actions you can take to speed up the process and get back to your life if you have been involved in a car accident.

  • Seek medical attention immediately for you or others involved in the car accident. The welfare of the involved parties should obviously be the first thing anyone worries about. However, do not discuss the accident with anyone, even if it may have been your fault. Admission may become valid in court at a later date.
  • Be sure to get the names, addresses, and phone numbers of witnesses to the car accident. Although police will speak with witnesses, you will still have the information if it is lost later on. Write down all information as soon as you can since the witnesses may not wait around for authorities to show up to make a statement.
  • Take pictures of the vehicles and the damage, as well as any skid marks. You should also take pictures that show the angle of the sun and weather as proof. Taking pictures from many angles may be important to your claim.
  • If the other party’s insurance company calls you to discuss a claim, do not say anything. The only contact between you and them should be done while your car accident attorney is present.
  • When you are filing your claim, take into account the statute of limitations. Do not wait until it is too late to file.

If you or a loved one has been in a car accident in the state of Oklahoma, please contact the experienced car accident attorneys at Self & Associates today.

Insurance Companies and Car Accidents

When someone is seriously injured in a car accident, medical expenses and lost income can quickly pile up, making them desperate for financial help. Insurance companies often take advantage of this by offering a small settlement that seems like a good deal at the time. In reality, the insurance adjuster wants your claim to go away as fast and as quietly as possible. They know that if you accept a smaller sum upfront, you may not be able to recover more from them in the future.

This is why it is so important to not accept settlements from insurance companies before consulting with an experienced auto accident lawyer. Attorney James Self knows exactly how to negotiate with insurance companies to make sure your rights are protected. He can help you understand the true value of your injury claim, and fight to pursue the compensation you deserve.

If an insurance company has denied your claim, failed to properly investigate your claim, or knowingly underpaid you, our experienced Oklahoma City injury lawyers can help you hold them accountable. Bad faith insurance is a common problem, but with an aggressive lawyer on your side, you have a much higher chance of resolving your dispute effectively.

If you have been seriously injured in a car accident and the insurance company is giving you the runaround, please contact Self & Associates today for a free case evaluation. We represent injured car accident victims throughout the state of Oklahoma.

Rear-End Car Accidents

Rear-end car accidents are the most common type of accident in Oklahoma City and throughout the United States. These accidents are the result of one car’s front end crashing into the back of another car. Some people assume these are minor accidents, but rear-end collisions can range in severity from minor to deadly. A low-speed, rear-end collision can leave victims sore and stiff; whereas a high-speed rear-end crash can leave victims permanently paralyzed.

During these types of car accidents, all of the energy from the rear of the vehicle car is transferred to the front end of the vehicle with a powerful jolt. Oftentimes the torso and the head are thrust forward, and then the head snaps backward, resulting in whiplash or serious injuries to the spinal cord. Often, the severity of these accidents cannot be determined from the damage to the vehicle.

Causes of Rear-End Accidents

The most common causes of rear-end accidents include drivers who are:

  • Careless
  • Inattentive
  • Distracted

Even if an Oklahoma City driver takes his or her eyes off the road for two seconds, another driver’s sudden stop can catch them off-guard and lead to a rear-end accident. The United States Department of Transportation cites texting, talking on cell phones, eating and drinking, personal grooming, and changing CDs or the radio station as some of the most distracting behaviors that lead to accidents.

Common Causes of Car Accidents in Oklahoma City

Driving doesn’t need to be a risky proposition. There should be no fear when you drive from one side of town to another. Yet, day after day, Oklahoma City residents are involved in completely avoidable car accidents . Some of these people are seriously injured, and a few may even be killed.

Knowing the most common causes of car accidents may help you avoid them.

Causes of Car Accidents

  • Driver fatigue – Drivers who are tired or fatigued are slower to react and may actually fall asleep behind the wheel. Avoid driving when you are exhausted and pay attention to other drivers, especially when driving at night
  • Distracted driving – Avoid texting, adjusting the music, daydreaming, watching the scenery and rubbernecking. Distracted driving accidents account for a larger percentage of all car accidents every year. Pay attention to the road
  • Driving under the influence of drugs or alcohol – Driving under the influence is one of the most maddening reasons people are injured and killed in accidents every year because they are completely avoidable. Do not drive if you’ve had too much to drink or are under the influence of drugs. It may be trite, but know when to say when
  • Aggressive driving – Stay calm when behind the wheel. Speeding, weaving from lane to lane, and ignoring traffic signs and signals can cause serious accidents. If you are around someone driving aggressively, slow down and get out of their way if possible. Call 911 if you believe they are a danger to you and other drivers on the road
  • Weather – Pay attention to the weather, especially during the stormy months of the year. Rain, sleet, and snow require slower driving, giving yourself more time, and staying at a greater distance from other vehicles. Stay home if it seems unsafe to drive and heed the meteorologists

Whiplash Injuries Following Automobile Accidents

There are approximately 1,000,000 whiplash injuries reported in the United States every year. Of these, 40,000 result in chronic, debilitating pain. 33 percent of that 40,000 will continue to have serious pain for three years of more.

Whiplash is the most common injury sustained in automobile accidents in the state of Oklahoma. Impact to any area of your car can cause your head to violently shoot forward and backward, damaging joints, ligaments, disc cartilage, cervical muscles, and nerves. Even when the pain and limited mobility are short-term, a whiplash injury makes your neck more susceptible to future injury for the rest of your life.

Seeking Compensation for Whiplash

When you are injured in an automobile accident that results in whiplash, your ability to work will be negatively impacted while medical bills begin to pile up. Combined, these factors can leave many Oklahomans struggling to make ends meet. Insurance companies are more concerned with protecting their profits than with ensuring your recovery, and will often offer a settlement that is inadequate to cover all of your damages.

Experienced car accident attorney Jay Self has been helping families in Oklahoma recover from the economic and emotional impact of whiplash injuries for over 30 years. Working closely with you to help determine all of your needs, Attorney Self can assist in making sure you are awarded all you are due.

Teens and Auto Accidents

Teenagers are not generally considered the safest drivers on the road, but in the state of Oklahoma, teenagers are only involved in 14 percent of all reported car accidents. Teenagers may become more easily distracted than adult drivers, but alcohol and drugs are not the major contributors you might assume.

In fact, according to the National Highway Traffic Safety Administration (NHTSA), less than a quarter of accidents caused by teens involved alcohol or another intoxicant. The largest contributing factor to auto accidents involving teenagers is excessive speed. According to NHTSA, speeding is a factor in over 33 percent of these accidents.

Oklahoma Teen Driving Laws

To help combat accidents caused by teens, the state of Oklahoma passed a graduated licensing law for teens in May 1999. This law requires:

  • Teen drivers between 15 and 16 to be accompanied by an adult
  • A learners permit to be held for six months before a license is granted

An intermediate license is granted to teens over the age of 16 who have:

  • Completed 50 hours of on the road drive time
  • Completed at least 10 hours of night-time driving
  • Had no traffic violations

An unrestricted license can be granted to teens who have:

  • Held an intermediate license for one year, or completed drivers education
  • Have zero driving violations on their record

Even with these laws, accidents involving teens still regularly occur. Teenagers are 25 percent more likely to die in traffic accidents and, with developing bodies, more likely to sustain serious personal injury when involved in an accident. Representing injured teens and adults, the car accident attorneys at Self & Associates can help you and your family recover after any type of accident.

Questions About Car Accidents

Can I collect damages in a car accident when no police report was filed?

Police reports are important when filing a personal injury lawsuit following a car accident. If police did not come to the scene of your accident, contact them as soon as possible after the accident to file a report. Be sure to include pictures, repair expenses, and related medical evidence.

What exactly is distracted driving?

One of the leading causes of catastrophic car accidents in Oklahoma is distracted driving. Distracted driving occurs anytime a driver is paying attention to something other than the road. For example, distracted driving might include:

  • Texting while driving
  • Talking to passengers
  • Eating while driving
  • Lighting a cigarette

If a traffic light malfunctions, who is liable for a car accident?

It is the job of local governments to ensure traffic lights and other traffic signals are working properly. If a light fails and a car accident occurs, it may be the responsibility of a local municipality to cover damages for all people and vehicles involved. An experienced car accident attorney like James Self will be able to help you establish who is at fault for your accident.

Can I rely on insurance to pay for my damages in a car accident?

Insurance companies may pay for some of your damages in a car accident, but they almost never provide you with the full amount compensation you will need to recover. You need an experienced car accident attorney on your side to ensure that the full extent of your injuries – including the long-term consequences they will cause – are taken into account.

Seatbelts and Car Accidents

Car accidents have the potential to cause serious injury or death. There are many potential sources of injury, such as impacting surfaces in the car’s interior, being crushed by the crumpling car, or being thrown from the vehicle. To attempt to reduce the risk of injury, cars employ many types of safety equipment, and the seat belt is probably the most important.

A seat belt protects drivers and passengers in many ways:

  • It reduces risk of hitting car interior
  • It absorbs some of the kinetic energy of impact
  • It reduces risk of ejection from vehicle
  • It keeps passengers in areas designed for their safety

The final component is even more crucial in modern cars, whose specifically engineered “crumple zones” are designed to collapse in certain ways to absorb the energy of impact. Keeping passengers out of collapsing parts of the car ensures maximum protection. Seat belts are especially important in some types of accidents. In rollover accidents, for example, 88% of fatalities involve people not wearing seat belts at the time of the accident.

Seat belt use not only protects you from injury, it’s the law in Oklahoma. Since 1999, you can be pulled over and ticketed for not using your seat belt. States with this kind of law have seen a 20% reduction in fatal car accidents, and the spread of these laws is responsible for our record-low rates of car accident fatalities.

However, seat belts are not complete protection against injury, and defective seat belts provide little or no protection. If you have suffered injury in a car accident due to the negligence of another driver and/or a defective seat belt, an injury lawyer can help you get compensation for your injury.

Rear-End Car Accidents in Oklahoma

Rear-end car accidents account for nearly 40 percent of car accidents in Oklahoma. Even though these accidents are often at low speeds, the consequences of rear-end car accidents can be catastrophic for the driver and passengers of the car that was hit.

The most common cause of rear-end car accidents is driver distraction. Talking or texting on a cellphone, changing a station on the radio, fiddling with an MP3 player, applying makeup, or eating while driving are all too common on Oklahoma roadways. When a driver takes their eyes off the road to perform a needless task, they endanger everyone else on the road. When their negligence results in injury or death, they are liable for their behavior.

How Jay Self Can Help

For over 30 years, auto accident attorney Jay Self has been helping Oklahoma families injured in rear-end collisions get the compensation they need to recover. Taking into account the full extent of your damages, Attorney Self can often help you get a settlement that far exceeds the offerings of insurance companies.

If you or a loved one has been injured in a rear-end car accident in the state of Oklahoma, please contact experienced car accident attorney Jay Self at Self & Associates to schedule a free consultation today.

Car Accidents in Parking Lots

Motor vehicle accidents do not always occur on the open road. A bustling parking lot can feature a gauntlet of obstacles – from runaway carts to distracted drivers – and any lapse in attention may result in an accident. About one-fifth of car accidents occur in parking lots, and while they might not be high-speed, serious injury can still occur.

Aside from inanimate hazards, such as light poles and carts, other drivers and pedestrians are the most unpredictable factors in a parking lot. A fellow motorist may disobey directional markers or speed to obtain a spot, putting everyone at risk. This negligence can easily lead to an accident, damaging your vehicle and leaving you with costly injuries.

Low-speed accidents sometimes result in whiplash, which can leave you with a wide range of soft tissue neck injuries. Severe whiplash may even lead to a brain injury. If you or a loved one has been injured in a parking lot accident caused by a negligent driver, do not underestimate the damage to your property and health. Our personal injury lawyers at Self and Associates can help you obtain the compensation you deserve.

Please contact Self and Associates today if you or a loved one is in need of legal assistance after a parking lot accident.

Defective Vehicles

Car accidents can be caused by several different factors. While many accidents are simply the result of driver error and recklessness, others might be caused by poorly-maintained roadways, and still others are caused by defective vehicles.

Defective vehicles contribute to many avoidable accidents on Oklahoma roadways every year. When a vehicle is defective, no amount of defensive driving can prevent an accident. The driver of a defective vehicle may initially seem responsible for an accident, even though they were taking every possible precaution. With experienced car accident attorney James Self on your side, a thorough investigation will be made into the cause of your accident to help ensure you are not held liable for an accident caused by a defective vehicle.

The news has been full of stories about auto recalls in the past several years. On many occasions, a vehicle is recalled before any serious injuries have occurred. Unfortunately, all too often a defect is missed by the manufacturer, or caught too late to prevent injuries.

Vehicle manufacturers have a responsibility to adhere to a high safety standard when designing and producing their vehicles. When they fail to do so and someone is injured as a result, the company can be held accountable for negligence. Personal injury attorney James Self has over 30 years of experience litigating cases against negligent car manufacturers. He will fight to help you secure every penny you deserve.

Cell Phones, Smart Phones and Car Accidents

Distracted driving has become an epidemic, and a leading cause of deadly accidents on today’s roadways. Driving while intoxicated has long been one of the primary causes of car accidents, but recent research shows that distracted driving can be even more dangerous, impairing your reaction time to a disastrous extent. Unfortunately, unlike drunk driving, most people are not aware of the dangers of distracted driving, and therefore do not take measures to avoid it.

Cell phones take a driver’s attention away from the road. Simply answering a call can result in total distraction for several seconds. In that short period of time, a swiftly moving vehicle can cover a football field and miss a last-minute turn signal. The dangers of texting while driving are also well-documented, and it is estimated that the risk of having a serious accident while texting increases 23-fold. Many people underestimate how severely impaired they are while on their cell phones, and their negligence causes thousands of accidents, injuries, and deaths yearly.

Distracted driving caused by cell phone usage is an alarming trend. If you have been injured, or if your loved one has been killed in this type of accident in the Oklahoma City area, you may be entitled to compensation.

Please contact Self and Associates today to schedule a free consultation with an experienced Oklahoma City accident attorney.

Intersectional Auto Accidents

In the state of Oklahoma, intersections are the most common location of all car accidents that result in serious injury. The reason accidents at intersections offer a larger opportunity for injury is the location of impact.

The common collision points in intersectional car accidents are front and rear quarter panels. Unlike bumpers which are designed for impact, these portions of your car lack sufficient protection. Side impact collisions are the leading cause of catastrophic injury and death because your car was not meant to be hit at that angle.

Avoiding Intersectional Auto Accidents

On the road, you can only control your own behavior. While at intersections, take the time necessary to ensure other motorists are not trying to pass through at the same time. Even at green lights or when you have the right of way, you cannot anticipate the actions of distracted or erratic drivers.

Even the most careful driver cannot always avoid collision. If you are injured in an intersectional auto accident caused by another driver, you have a right to seek full compensation for all of your damages. Experienced car accident attorney Jay Self can help ensure you are treated fairly, and given the full amount you are due.

What Cars are Safest in an Accident?

Forbes Magazine compiled a list of the safest vehicles of 2012, based on crash test results and spec sheets to see which vehicles ranked highest for protecting occupants in the event of a car accident.

Testing Criteria

The 2012 safest vehicles were chosen based on their frontal crash tests (at 40 mph), side-impact tests, rear-end collisions (at 20 mph) and rollover protection ratings based on roof crush tests. All vehicles in Forbes Magazine’s list include blind-spot warning systems that employ sensors or cameras to detect vehicles in the blind spot, lane departure warning systems to alert inattentive drivers they are veering into another lane, and collision warning systems to help keep drivers at a safe distance and speed from the nearest vehicle in its path.

Safest Vehicles

The safest vehicles of 2012 are:

  • Audi A6
  • BMW 5 Series
  • Infiniti EX 35
  • Infiniti M37/M56
  • Mercedes-Benz E-Class
  • Mercedes-Benz M-Class
  • Volvo S60
  • Volvo S80
  • Volvo XC60

You will notice that only a few manufacturers are represented in this list, which is prejudiced by the mandatory inclusion of certain pricey safety features, some of which have yet to be proven effective.

The U.S. Department of Transportation reported that 32,885 people died in motor vehicle accidents in 2010, which is actually the lowest number of deaths since the record keeping started in 1949. Still, every 16 minutes an American is killed in a motor vehicle crash.

Why Do I Need an Attorney for My Car Accident?

If you have been involved in a car accident in Oklahoma City and suffered injuries, it is a good idea to hire a car wreck attorney. An experienced car accident lawyer can help you recover damages by negotiating with the at-fault party’s insurance adjustors and taking your case to court if need be.

You may choose to represent yourself, but keep in mind that the defendant’s insurance company will try to settle your claim for as little money as possible, and even attempt to have your case thrown out on a legal technicality. If you do not have a strong command of personal injury law, you could forfeit your right to compensation.

It is important to keep in mind that once you accept an offer from the insurance company, your claim is finalized and there is not much you can do to recover more money in the future. Therefore, your best chance of maximizing compensation and avoiding financially-detrimental mistakes is to hire a car accident injury attorney from the beginning. A car accident injury attorney has experience in estimating damages and can make sure you’re not leaving out any important future concerns.

Defective Seatbelts and Car Accidents

The NHTSA (National Highway Traffic Safety Administration) reports that 63% of all people who are killed in car accidents are not wearing a seatbelt at the time of the incident. In contrast, close to 10,000 lives are saved every year thanks to seatbelts – even though they are only worn by 81% of all drivers.

Unfortunately, even when you are responsibly wearing your seatbelt on a regular basis, the seatbelt itself may be defective. Design flaws, manufacturing errors, and improper labeling can all contribute to a situation where your seatbelt fails you in an accident.

Dos and Don'ts Following a Car Accident

If you become involved in an Oklahoma City car accident, it is important to know what to do and what not to do, in order to protect your rights.

Here are some things you should do:

  • First and foremost, call an ambulance if anyone is injured
  • If you are not hurt, move your vehicle to the side of the road, so it is safely out of the way of other vehicles.
  • If your vehicle cannot be moved, turn on your hazards or set up flares to warn others about your damaged vehicle.
  • Exchange information with everyone else involved in the car accident. Be sure to record their name, address, insurance company and policy number, driver’s license number, license place and a description of all other vehicles.
  • Photograph the accident scene, and take notes about what happened while it is vivid in your mind. Be sure to include any inclement weather, road conditions, signage, or anything else that may have played a role in your accident.
  • File an accident report, even if there are no injuries. This documentation will help expedite the claims process, and can work to your advantage.

You should never:

  • Admit fault
  • Leave the scene of the accident
  • Sign any documentation from the other party’s insurance company
  • Make a statement to anyone but the police without consulting an Oklahoma City car accident attorney

If you have been injured in a car wreck in Oklahoma City, please contact Self & Associates today to arrange your complimentary consultation.

If you become involved in an Oklahoma City car accident, it is important to know what to do and what not to do, in order to protect your rights.

Here are some things you should do:

Causes of Car Accidents

Any number of factors can contribute to a car accident. Some accidents are caused by other drivers, while others can be caused by faulty vehicles or severe weather conditions. No matter what the cause of your accident, if you have sustained an injury, you need an attorney on your side to make sure you secure the full amount of compensation you are entitled to.

Driver-Related Car Accidents

Many car accidents are caused by driver error. Some examples of these accidents include:

In these types of accidents, it may be simpler to prove who was at fault. However, you will still need an attorney to make sure insurance companies do not try to minimize your payment and withhold the damages you are due.

Unavoidable Car Accidents

Not all accidents are caused by driver error. Some examples of accidents that may be beyond a vehicle operator’s control include:

  • Defective vehicles
  • Defective roadways

In these instances, identifying the responsible party can be more difficult. An experienced attorney like James Self will be essential in helping you investigate the details of the accident, determining exactly which parties are at fault, and pursuing the compensation you deserve.

Night-time Driving and Car Accidents

Although there are fewer drivers on the road at night, more than 40 percent of all fatal car accidents occur after the sun goes down. While our eyes adjust to lower levels of light, it can become tricky to see when adjusting from bright lights to darkness. This can happen quite a bit when looking into the headlights of oncoming traffic.

Some hazards that are characteristic of night-time driving include:

  • Limited visibility
  • Driver fatigue
  • Lighting irregularities

In addition, driving just before sunrise or right after sunset can be dangerous when the sky is well-lit and the roadway becomes dark. This difference between light and darkness can make it difficult to see road hazards, signs, and other vehicles (especially if their lights are not on yet).

Night-time driving also means a greater chance of intoxicated drivers on the road. In fact, the majority of DUI accidents (under the influence of alcohol or drugs) occur in the late night hours or early morning between midnight and 3 a.m. For Okalahoma City motorists who work late hours, it may be impossible to avoid driving during this time, putting them at greater risk from intoxicated drivers.

Why do I need an Attorney after a Car Accident?

If you have been seriously injured following a car accident, you should contact an attorney to pursue compensation for your injury-related expenses. On the other hand, very minor accidents resulting in little or no car damage, and no bodily injuries, may not require an accident attorney to resolve.

An attorney is a valuable component of your claim. Your attorney will:

  • Communicate with the insurance company.
  • Determine if a settlement is fair.
  • Help you collect necessary documentation.

If you have been injured, it is important to contact an attorney because of the possible effects of the injury. Your injury may require expensive treatment, and severe injuries, like those of the head and brain, may require ongoing or lifelong treatment. You may be disabled and unable to work, which will reduce your income. The physical pain may be excruciating, and you may experience depression and emotional pain as a result. If the accident was not your fault, you should not have to suffer these consequences while the careless driver pays nothing.

If you have been injured in an accident and are searching for a car accident attorney in the Oklahoma City area, please contact experienced Oklahoma attorney James Self to schedule a free consultation at Self & Associates.

Dos and Don'ts Following a Car Accident in Oklahoma

Red Light Running Car Accidents

Car accidents at intersections are among the most dangerous type of accident. The Insurance Institute for Highway Safety (IIHS) has identified intersection accidents, especially those caused by red light running, as a major threat to the health and safety of people on our roads.

According to IIHS, 676 people were killed as a result of red-light running accidents in 2009, and 113,000 suffered injury. Unfortunately, most of the time the people killed are not the driver responsible. Sixty-four percent, or nearly two-thirds, of those killed were people other than the driver running the red light. About half (46%) of those killed were in the vehicle obeying the traffic signal.

These numbers have been coming down recently, according to the IIHS, due to an increased use of red light cameras. The statistics are heartening. In cities where red light cameras are installed, the number of injury crashes can reduce anywhere from 13% to 32%, with front-to-side injury crashes reducing by as much as 68%. Some worry that red light cameras may lead to an increase in rear-end accidents, but not all studies show this trend. Even in studies that do show increased rear-end accidents, the overall cost of accidents decreased due to the fact that rear-end accidents tend to be lower-severity. Red light cameras have been installed in Oklahoma City, Norman, and Tulsa, but we don’t have statistics for their impact yet.

Red light running remains a major factor in car accidents, and still leads to death and serious injury. If you have suffered injury or lost a loved one due to this type of accident, you may be able to receive compensation for your injury or loss.

Most Common Car Accident Injuries

Car accidents can cause various injuries, ranging from minor to severe and affecting practically any body part. Some of the most common injuries resulting from car accidents include:

  • Back injuries: the impact from a motor vehicle accident can result in back injuries that range from back sprain and disc injury to fracture and even paralysis.
  • Brain injuries: one of the most common injuries resulting from a motor vehicle crash is a head injury that can cause brain damage. Even when there is no physical indication of trauma (such as bleeding or bruising), a severe injury can result just from the brain being jostled inside the skull during impact.
  • Facial injuries: unfortunately, motor vehicle accidents can cause severe injuries to the face from colliding with the dashboard, steering wheel, airbag or windshield. Facial injuries can range from cuts and bruises to severe lacerations and jaw disorders.
  • Neck injuries: whiplash and spinal cord injuries are other types of injuries that commonly result from a motor vehicle accident.

Insurance adjusters will sometimes point to the damage to your car as evidence that you could not have suffered serious injury, but flesh and bone injuries do not always compare to plastic and steel damage. We know this and know how to prove it.

Do you live in the Oklahoma City are? Have you suffered a personal injury due to another party’s negligence? If so, please contact Self & Associates today to schedule a free consultation.

Car Accidents

Many car accidents take place every day on our Oklahoma roads. A car accident could happen at any moment no matter how safe you drive. There are several causes of car accidents such as:

  • Hazardous road conditions
  • Inadequate signs
  • Unmarked construction zones
  • Absent warning signs
  • Distracted drivers
  • Inexperienced drivers
  • Weather conditions
  • Defective vehicles
  • Missing guardrails
  • Traffic lights that do not work properly

Even though another driver was not at fault, you may have a car accident case if the accident was caused by a defective vehicle or hazardous road condition. Oklahoma City car accident lawyer James Self will evaluate your case and determine who is at fault for your car accident.

Distracted Drivers

One of the biggest distractions for drivers is the use of their cell phone. Even a quick glance to press a button or type a text can lead to a serious auto accident. Other distractions for the driver of any vehicle can include rowdy passengers, applying makeup, reading maps. Anything that pulls your attention away from driving your vehicle safely can easily result in a car accident.

Defective Vehicles

A defective vehicle may have one or several parts that do not function correctly. Brakes, tires, or seatbelts that are not working as they should can cause an auto accident or fail to keep you and your passengers safe. A car accident lawsuit can be filed against the manufacturer of the vehicle or tires in cases where parts of the vehicle fails to perform how they should.

Hazardous Roads

A hazardous road is a road that has unmarked construction zones, inadequate signs, no guardrails, or uneven lanes. The condition of the road may cause you to drive off the street, swerve into the median, or hit another vehicle. If the condition of the road caused your car accident, certain government entities may be at fault.
