Questions about Workers' Compensation in Oklahoma

Workers' Comp Lawyers serving Oklahoma City, Midwest City and cities throughout Oklahoma

What is workers' compensation?

Workers' compensation law requires that employers provide medical care and compensation for an employee who is injured at work during the course of that employee's assigned duties.

If you have an Oklahoma Workers' Comp Question, we're here to help.

Workers' compensation laws differ slightly from state to state; however, you may be entitled to the following compensation if you have been injured on the job:

  • Wages lost due to work missed or decreased earning capacity
  • Medical bills
  • Other medical expenses
  • Compensation to dependents if employee was killed

How do I know if I am eligible for workers' compensation benefits?

To be eligible for workers' compensation, you must be unable to work for more than 3 calendar days due to a personal injury suffered from your working environment. To find out if you are eligible for workers' compensation and to find out what compensation you may be entitled to, please schedule a free case evaluation with Oklahoma City workers' compensation lawyer James Self. Mr. Self has the experience you need to recover compensation for your on-the-job injuries.

How are my workers' compensation benefits calculated?

Your benefits will be based on the type of impairment and the benefits allowed by law. After your doctor has evaluated the percent of your impairment, the level of your disability can be determined. Your workers' compensation benefits are then calculated based on the state's average weekly wage (SAWW) and your average weekly wage (AWW).

Oklahoma law provides benefits up to 70% of your AWW and up to the 100% of your SAWW. From November 2010 through October 2011, that SAWW benefit is $716 per week, and is reviewed annually.

How long do I have to report an injury to my employer?

It is a good idea to immediately report any injury you suffered from a work related accident to your employer. Your claim for workers' compensation may be denied if you do not report your injury to your employer or seek medical attention for your injury within 60 days following your accident.

To make sure you get the compensation you deserve for your work related injury in Oklahoma City, please contact the skilled workers' compensation lawyers at Self & Associates today for a free evaluation of your case.
