How do I know if I am eligible for workers' compensation benefits?

To be eligible for workers' compensation, you must be unable to work for more than 3 calendar days due to a personal injury suffered from your working environment. How are my workers' compensation benefits calculated?

Your benefits will be based on the type of impairment and the benefits allowed by law. After your doctor has evaluated the percent of your impairment, the level of your disability can be determined. Your workers' compensation benefits are then calculated based on the state's average weekly wage (SAWW) and your average weekly wage (AWW).

Oklahoma law provides benefits up to 70% of your AWW and up to the 100% of your SAWW. From November 2010 through October 2011, that SAWW benefit is $716 per week, and is reviewed annually.

How long do I have to report an injury to my employer?

It is a good idea to immediately report any injury you suffered from a work related accident to your employer. Your claim for workers' compensation may be denied if you do not report your injury to your employer or seek medical attention for your injury within 60 days following your accident.
