Workers' Compensation Eligibility
Workers' compensation covers injuries that occur to employees out of and in the course of employment. However, it can be hard to understand what, exactly, that means. Here is a quick guide to Oklahoma law.
Who Is an Employee?
Employees are defined under Oklahoma law as "any person engaged in the employment of an employer covered by the terms of the Workers' Compensation Code." It can also include Oklahoma National Guard members employed by state order, as well as volunteers for authorized organizations that are performing services as a firefighter, peace officer, or emergency management worker. It also refers to a participant in a certified sheltered workshop program.
Who Is an Employer?
An employer is, except for certain exemptions, "a person, partnership, association, limited liability company, corporation, the legal representatives of deceased employers" or state and local governments.
What Is a Compensable Injury?
A compensable injury for workers' compensation must arise "out of and in the course of employment." It is divided into two major categories. One category is caused by a specific incident that is identifiable in time, place, and occurrence. The other, called cumulative trauma, does not have to be associated with a specific instance. It includes cardiovasacular, coronary, pulmonary, respiratory, or cerebrovascular accident or myocardial infarction, but only when it can be established that a work-related activity is the major cause of harm, and it has to be shown that these were caused by extraordinary circumstances.
In addition, compensable injury covers damage to your prostheses like eye glasses, glass eyes, replacement limbs, and others that are considered "medically necessary."
It does not include psychological injury or trauma, unless it's related to a physical injury or crime of violence that occurs "out of and in the course of employment."
Proving Compensable Injury
Unfortunately, Oklahoma law puts the burden of proof on you for showing that your injury is compensable. To do this, you must show:
- You were injured, using "objective medical evidence"
- Your injury was related to your work
- Your injury was not due to recreational or social activities
- Was not due to aging, natural causes, or diseases not related to work
Sometimes, this is easy to prove. Other times, an injury lawyer may be helpful in proving these points.

Workers Rights
Workers’ rights have been hard to obtain, but after more than a century of battling, most of us enjoy considerable protections and rights under the law. These rights fall into many categories, but some of the most important include your right to a safe workplace, and your right to workers’ compensation for injuries in the workplace. You have the right to report dangerous conditions: If you notice violations of safety codes that put you or other employees at risk, you can report these violations to OSHA, who can investigate them and ask your employer to remedy the violations.
You have the right to workers’ compensation: If you are injured in a workplace accident, you have the right to compensation for resulting medical bills and lost wages. It doesn’t matter if the accident was partly or wholly your fault.
You have the right to protection for workplace safety claims:Whether you are reporting violations to OSHA or filing a workers’ compensation claim, you are protected from retaliation by your employer. Workers Compensation Back Injuries
Back injuries are among the most common workplace injuries. More than one million American workers are adversely affected by back pain. Back pain is responsible for more lost work than any other musculoskeletal disorder, with nearly half a million workers missing at least one day of work due to back pain, and about 100,000 back pain sufferers miss 31 or more days of work a year.
Back injuries affect workers in all economic segments, including:
- Retail
- Medicine or nursing
- Manufacturing
- Transportation
Worse, back injuries can be hard to properly document for compensation with workers’ compensation claims.
Under Oklahoma law, there are sample benefits prescribed for most types of injuries, such as a lost finger, broken arm, or amputation injury, but back injury compensation is based on a doctor’s estimate of your percentage disability to the body as a whole. This is based on descriptions given in the American Medical Association’s Guides to the Evaluation of Permanent Impairment. This will be based on the degree of your impairment in many types of activities, such as lifting, bending, sitting, walking, stooping, and other activities.
Back injury is highly susceptible to re-injury, so it’s important that if you return to work you are given appropriate limitations.
The workers’ compensation lawyers of Self & Associates have experience helping injured workers in Oklahoma City to get the compensation they deserve. For help with your workers’ compensation claim, please contact Self & Associates today for an appointment.

Workers Comp: Head Injuries
Any time you are injured on the job, it can have devastating consequences on your personal and work life. When you suffer a head or brain injury on the job, you are likely facing high-cost medical care and a long absence from work, if not permanent disability. Consulting a workers' compensation lawyer is the first step to recovering all of the compensation that you are entitled to.
When you suffer on-the-job injuries, you must go through the workers' compensation system to receive benefits for your injury unless you have a separate claim for negligence. All of this can seem like it's too much to handle when you are just trying to recover from your injuries.
Especially where head injuries are concerned, you want a workers' compensation lawyer on your side to guide you through the process and make sure that you are making the correct claims against the correct individuals to recover as much as you possibly can. If you are not able to return to work, you want someone representing you who will fight for the vocational rehabilitation or permanent disability benefits that you deserve.

Why Do You Need a Workers Compensation Attorney?
Technically, you don’t. Workers’ compensation is designed to be easy to file and should ensure you get compensation without having to defend yourself or your actions to anyone.
Unfortunately, the reality is often very different. “Easy” as defined by lawyers and bureaucrats is not the same as it is when defined by regular people or workers trying to get compensation. Although the instructions are “clear,” it can be next-to-impossible for people without legal training or experience with the law to file for the compensation they need.
Some injuries are particularly difficult to document. If your injuries are related to pain or nerve damage, it is not uncommon for doctors, employers, and workers’ compensation insurance companies to allege that you are either not hurt or are not hurt as badly as you claim.
Other times, your employer may try to make you defend your workers’ compensation claim. He may allege that you were on drugs at the time of the accident, that the injury was the result of a pre-existing condition, or that you suffered injury when you were off-the-clock or at a non-work-related activity.
If you are having trouble filing for or getting compensation for your work-related injury, a workers’ compensation attorney can help. Please contact Self & Associates in Oklahoma City today for a consultation.
