Oklahoma Kratom Wrongful Death Cases

A Kratom wrongful death investigation may involve questions about the product that was used, the amount consumed, the concentration of Kratom alkaloids or 7-OH, how the product was labeled and marketed, where it was purchased, and whether other medications or substances may have been involved.
A death certificate or toxicology report may be an important starting point, but it may not tell the entire story. A serious wrongful death investigation may require review of medical records, autopsy findings, toxicology, product chemistry, labeling, manufacturing information and the companies involved in placing the product into the marketplace.

Serious Oklahoma Kratom Stroke, Brain Injury and Cardiac Cases

Serious neurological and cardiovascular events have been reported after the use of Kratom and Kratom-derived products. That does not mean Kratom caused every stroke, cardiac event or other medical emergency occurring after its use. What Is Kratom?
Kratom comes from the leaves of Mitragyna speciosa, a tree native to Southeast Asia. Kratom products may be sold as powders, capsules, liquids, extracts, shots, tablets, gummies and other forms.
Two of the alkaloids receiving significant attention are mitragynine and 7-hydroxymitragynine, commonly called 7-OH. Products sold under the broad label of "Kratom" can vary substantially in formulation and concentration, making the identity of the exact product important in a serious injury or wrongful death investigation.
What Is 7-OH?
7-hydroxymitragynine occurs naturally in Kratom in relatively small amounts. More recently, concentrated or enhanced 7-OH products have been marketed as tablets, gummies, drink mixes, shots and similar products.
The U.S. Food and Drug Administration has expressed particular concern about products containing added or enhanced levels of 7-OH and has described concentrated 7-OH products as novel potent opioid products.

Oklahoma Has a Law Specifically Regulating Kratom Products
The Oklahoma Kratom Consumer Protection Act
Oklahoma regulates the preparation, labeling and sale of Kratom products through the Oklahoma Kratom Consumer Protection Act.
Among other requirements, Oklahoma law prohibits certain Kratom products, including products containing more than one percent (1%) 7-hydroxymitragynine in the alkaloid composition and products containing synthesized Kratom alkaloids.
The law also contains labeling requirements and prohibits vendors from selling or distributing Kratom products to anyone under 18 years of age.
Oklahoma Law May Give Injured Consumers a Civil Claim
Oklahoma law expressly provides that a person aggrieved by a violation of certain provisions of the Kratom Consumer Protection Act may bring a civil action for damages resulting from that violation, including economic, noneconomic and consequential damages.

Does the Exact Kratom or 7-OH Product Matter?
Yes. In a serious injury or wrongful death case, identifying the exact product can be extremely important. Different products may contain different concentrations, ingredients, extracts or formulations, and the name appearing on the front of the package may not identify every company involved in producing and distributing it.
If Possible, Keep the Product and Packaging
- The bottle, package, pouch or wrapper
- Any remaining product
- Lot or batch numbers
- Receipts and credit-card records
- Photographs of the product and label
- Online order confirmations
- The name and location of the retailer or seller
What About Specific Kratom and 7-OH Brands?
Examples of brands or products that have appeared in FDA warnings, safety communications or public litigation include:
- OPMS Black Liquid Kratom — the FDA issued a consumer safety alert specifically addressing this product.
- 7OHMZ / 7-OHMZ — FDA warning letters identified products including 7-OH tablets, gummies and shots.
- Hydroxie — FDA identified multiple concentrated 7-OH tablets, strips, shots and related products.
- 7Tabz — FDA warning letters identified concentrated 7-OH products sold under this name.
- EDP Kratom / RRR Trading — FDA specifically identified an EDP 7OH Mitragyna Speciosa Extract 50 mg shot.
Other companies and products have also appeared in FDA regulatory actions involving concentrated 7-OH products.
The fact that a company or product appears in an FDA warning, safety communication or lawsuit does not by itself establish that every product sold by that company is defective or that the product caused a particular injury. Each case must be investigated based on its own facts.
Who Could Be Responsible for a Kratom Injury or Death?
The company name printed on a bottle or package may be only one part of the product's path to the consumer. A serious product investigation may need to identify every company involved in manufacturing, processing, packaging, distributing and selling the product.
Depending on the facts, an investigation may examine whether the product complied with Oklahoma law, whether its contents matched the label, whether adequate warnings were provided, whether the product contained unexpected or prohibited substances, and whether the product was defectively manufactured, formulated or marketed.
What If Other Drugs or Medications Were Found?
The presence of another prescription medication, over-the-counter drug, alcohol or other substance does not automatically prove or disprove a Kratom injury claim.
In a serious case, qualified medical and toxicology experts may need to evaluate whether Kratom or 7-OH caused the event, substantially contributed to it, interacted with another substance, or had little or no role in the injury or death.
That is one reason serious Kratom cases should be evaluated from the complete medical and toxicological evidence rather than from a single laboratory result.
What If the Injured Kratom User Was Under 18?
Oklahoma law prohibits vendors from distributing or selling Kratom products to an individual under 18 years of age.
When a minor suffers a wrongful death, stroke, permanent neurological injury, major cardiac injury or another catastrophic event after obtaining a Kratom or 7-OH product, an investigation may include where the product came from, who sold it, what age-verification procedures were used, what the product contained and whether Oklahoma law was followed.
The fact that a minor used the product does not necessarily prevent a claim. The particular legal violation, product and medical evidence still must be connected to the serious injury or death.

Frequently Asked Questions About Oklahoma Kratom Injury and Wrongful Death Cases
Is Kratom illegal in Oklahoma?
Oklahoma permits the sale of qualifying Kratom products but regulates those products through the Oklahoma Kratom Consumer Protection Act. The law restricts certain product formulations, establishes labeling requirements and prohibits sales to individuals under 18.
Is 7-OH the same as ordinary Kratom?
7-hydroxymitragynine occurs naturally in Kratom in relatively small amounts, but concentrated or enhanced 7-OH products can contain much higher levels and may be sold as tablets, gummies, drink mixes or shots. The FDA has specifically distinguished these concentrated products from naturally occurring trace amounts of 7-OH in Kratom leaf.
Can Kratom or 7-OH cause a stroke?
Serious neurological events, including stroke and brain injury, have been reported in connection with Kratom use. That does not establish that Kratom caused every such event. Determining causation requires review of the medical history, timing, toxicology, exact product and other possible causes.
