State and federal laws require the pharmacy to do a drug utilization review and offer counseling concerning the prescription before the patient receives it. A drug utilization review requires the pharmacy to obtain the patients drug, allergy and medical history to determine if the prescription is appropriate for that person to consume. This allows the pharmacist to determine if the patient is allergic to the prescription drug, is taking another drug that should not combine with the prescription drug or if the patient has a heath condition that would not allow them to take the prescription drug safely.

After the prescription is filled and the dosing label is placed on the bottle the pharmacist has a duty to council or offer to council the patient by questioning them to determine this is in fact their prescription for the appropriate medical condition, in a safe an appropriate dose and what side effects they might expect.

This often occurs in big chain pharmacies who fill millions of prescriptions and don't take the time to perform all their obligations to ensure their patrons are safe.
