Provoking the dog would involve striking or other abuse. Trespassing would require the victim to be in a place he was not legally entitled to be at the time they were attacked or bitten. A person is not trespassing if they are lawfully on the property of the owner of the dog either expressly or impliedly. A legal purpose includes: as a guest, postal worker, utility meter reader, repair or construction worker, lessee or lessor, or for another legal purpose.
Other people can be victims of dog attacks and dog bites when the dog is allowed to run loose or has escaped from its restraints. The dog owner is also liable in these instances.
